As a seller of second-hand mobile phones, tablets, and other electronic items in the UK, we are committed to upholding your statutory rights under the Consumer Rights Act 2015. This document outlines your statutory rights and provides details of our additional limited warranty. Please read this information carefully and retain it for your records.

1. Your Statutory Rights under UK Law

As a consumer in the UK, you have certain statutory rights regarding the goods you purchase. Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose, and as described.

  • Satisfactory Quality: Goods must meet the standard that a reasonable person would consider satisfactory, taking into account their description, price, and all other relevant circumstances, including whether the goods are new or second-hand. For second-hand goods, reasonable wear and tear and any disclosed imperfections are taken into account.
  • Fit for Purpose: Goods must be fit for the purpose for which they are supplied, as well as any specific purpose you made known to us before you agreed to purchase the goods.
  • As Described: Goods must match the description we provided, whether verbally or in writing, including on our website.

If the goods we supply do not meet these statutory requirements, you may be entitled to certain remedies, including repair or replacement, or in some circumstances, a price reduction or a final right to reject the goods and receive a refund.

2. Earth Proven's Additional Limited Warranty for Refurbished Items

In addition to your statutory rights, Earth Proven provides a one (1) year limited hardware warranty on our refurbished mobile phones, tablets, and other electronic items from the date of original delivery. This warranty provides further assurance of the quality of our refurbished products.

3. Scope of our Additional Limited Warranty

This additional Limited Warranty applies specifically to refurbished products purchased directly from Earth Proven through our official website (https://www.earthproven.co.uk/) or authorized sales channels. This warranty is non-transferable and extends only to the original end-user purchaser.

4. What is Covered by our Additional Limited Warranty

During the one (1) year warranty period, Earth Proven warrants that the hardware components of the refurbished product will be free from defects in materials and workmanship under normal use and service. This additional warranty specifically covers:

  • Malfunctioning hardware components: Components that fail to operate as intended due to manufacturing defects or faulty materials that were not apparent at the time of purchase.
  • Issues affecting core functionality: Problems that significantly impair the primary functions for which the product was designed.

5. What is NOT Covered by our Additional Limited Warranty

This additional Limited Warranty does not cover the following, which are also relevant to the assessment of "satisfactory quality" for second-hand goods under UK law:

  • Fair Wear and Tear: Cosmetic imperfections, such as scratches, dents, scuffs, or discoloration that occur due to normal use over time and do not affect the functionality of the product. As these are inherent to second-hand items and are often reflected in the price, they are generally not covered.
  • Battery Degradation: The natural decline in battery capacity over time is inherent to rechargeable batteries and is not considered a defect in materials or workmanship. The warranty does not cover reduced battery life as a result of normal aging. We will, however, ensure that the battery retains a reasonable level of charge capacity at the time of sale, consistent with the age and condition of the device.
  • Damage Caused by External Factors: Damage resulting from:
    • Accident, misuse, abuse, or neglect, including physical damage such as drops, impacts, or excessive force.
    • Improper handling, storage, or operation of the product contrary to the provided instructions.
    • Exposure to extreme temperatures, humidity, or other adverse environmental conditions.
    • Power surges, electrical faults, or use of improper voltage.
  • Liquid Damage: Any damage caused by contact with liquids of any kind, whether internal or external. This includes corrosion or malfunction resulting from spills, submersion, or exposure to moisture.
  • Software Issues: Problems related to the operating system, pre-installed software, third-party applications, software updates, or software compatibility. This warranty covers hardware defects only.
  • Data Loss: Earth Proven is not responsible for any loss or corruption of data that may occur during the repair or replacement process. It is the customer's responsibility to back up all data before submitting a warranty claim.
  • Consumable Parts: Components that are expected to degrade or be consumed over time through normal use, such as certain accessories (unless explicitly covered for a specific period at the time of purchase).
  • Issues Arising from Unauthorized Modifications or Repairs: Defects or malfunctions resulting from any repair, alteration, modification, or disassembly performed by anyone other than an authorized Earth Proven representative or service partner.
  • Cosmetic Damage Disclosed at Purchase: Any cosmetic flaws that were clearly disclosed to you at the time of purchase are not covered by this warranty.
  • Connectivity Issues Not Due to Hardware: Problems related to network connectivity (Wi-Fi, cellular), Bluetooth pairing, or compatibility with other devices, unless the issue is demonstrably caused by a hardware defect in the Earth Proven product itself.

6. Warranty Voidance

This additional Limited Warranty will be immediately void if any of the following occur:

  • The product shows evidence of unauthorized repair, attempted repair, modification, or tampering.
  • The serial number, IMEI (International Mobile Equipment Identity), or any other identifying marks on the product have been altered, defaced, removed, or tampered with.
  • The product has been subjected to conditions or use outside of normal and intended operation as described in the product documentation.

7. Making a Warranty Claim (In addition to your Statutory Rights)

To make a claim under our additional Limited Warranty, you must follow the procedures outlined below:

  • Contact Customer Service: You must first contact our Customer Service team via our contact us page (https://www.earthproven.co.uk/index.php?route=information/contact). Please do not return the product without contacting us first.
  • Provide Required Information: When contacting us, please provide the following information:
    • Your original order number.
    • The date of purchase.
    • A clear and detailed description of the hardware defect you are experiencing.
    • Any troubleshooting steps you have already taken.
    • Photographic or video evidence of the defect, if applicable. This helps us to understand the issue and expedite the process.
  • Diagnostic Steps: Our Customer Service team may guide you through diagnostic steps to help identify and potentially resolve the issue. Please follow these instructions carefully.
  • Return Merchandise Authorization (RMA): If the issue is determined to be potentially covered under our additional Limited Warranty, we will issue you a Return Merchandise Authorization (RMA) number and provide you with specific return shipping instructions. The RMA number must be clearly marked on the outside of the package being returned.
  • Secure Packaging: You are responsible for properly packaging the product for return shipment to prevent further damage during transit. We recommend using the original packaging if possible.
  • Shipping Costs: You are responsible for the cost of shipping the product to us for warranty service. We recommend using a trackable shipping service and insuring the package, as Earth Proven is not responsible for items lost or damaged during return transit.

8. Warranty Evaluation and Resolution

Upon receiving the returned product with a valid RMA number, our certified technicians will inspect and evaluate the reported defect. If we determine that the defect is covered under our additional Limited Warranty, we will, at our sole discretion, take one of the following actions:

  • Repair the Defect: We will repair the defective hardware component(s) using new or refurbished parts that are functionally equivalent to the original parts.
  • Replace the Product: We will replace the defective product with a comparable refurbished product of equal or greater value and specifications. The replacement product will be covered by the remaining period of the original warranty or for ninety (90) days from the date of shipment of the replacement, whichever is longer.
  • Issue a Refund: If repair or replacement is not feasible, we may, at our discretion, issue a refund for the original purchase price of the defective product. The refund amount will not include any original shipping costs paid.

9. IMEI/Serial Number Verification

For returned refurbished devices such as phones or tablets, the IMEI (International Mobile Equipment Identity) or serial number will be carefully verified against our records to ensure that the returned device is the original device supplied under the original order. Any discrepancies may result in the voidance of the warranty claim and the return of the device to you at your expense.

10. Shipping Costs for Warranty Service (Return Shipment)

Earth Proven will cover the reasonable cost of shipping the repaired or replacement item back to you. We will typically use a standard shipping method of our choice. Expedited shipping options may be available at your expense.

11. Turnaround Time for Warranty Service

Please allow up to fourteen (14) business days after we receive the returned product for warranty inspection, processing, and repair or replacement. This timeframe may vary depending on the nature of the defect and the availability of necessary parts. We will make reasonable efforts to complete the process as quickly as possible and will keep you informed of the progress.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EARTH PROVEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER ECONOMIC ADVANTAGES, ARISING OUT OF OR IN CONNECTION WITH THIS LIMITED WARRANTY OR THE USE OR INABILITY TO USE THE PRODUCT, EVEN IF EARTH PROVEN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EARTH PROVEN'S TOTAL LIABILITY UNDER THIS LIMITED WARRANTY SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE PAID FOR THE PRODUCT.

13. Your Statutory Rights are Not Affected

This additional Limited Warranty is provided in addition to, and does not affect, your statutory rights as a consumer under the Consumer Rights Act 2015 and any other applicable UK law. You always have the right to claim against us if the goods do not meet your statutory rights.

14. Governing Law

This Limited Warranty shall be governed by and construed in accordance with the laws of England and Wales.

15. Entire Agreement

This document constitutes the entire agreement between you and Earth Proven concerning our additional warranty for the refurbished product and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Earth Proven with respect to the subject matter hereof.
